This week, President Barack Obama announced executive actions related to guns. Here are 10 common myths about firearms. 

Myth No. 1: Firearm purchases at gun shows do not require a background check due to the “gun show loophole.”

Facts:

When the president and others refer to the “gun show loophole,” they imply that there are no background checks being done at gun shows. As a result, much of the public has been misinformed and are led to believe that individuals who purchase firearms at gun shows are not subject to a background check.

In reality, there is no “gun show loophole.” If an individual wants to purchase a firearm from a licensed firearms retailer, which typically makes up the majority of vendors at gun shows, the individual must fill out the requisite federal firearms paperwork and undergo a National Instant Criminal Background Check System (NICS) background check.

The only firearms that are being purchased at gun shows without a background check are those being bought and sold between individuals, peer-to-peer, as opposed to buying a firearm from a gun dealer. These private sales are not at all different from selling a personal hunting rifle to the owner’s niece or nephew down the road. It is a private sale, and no background paperwork is required. The gun is private property, and the sale is made like a sale of the family’s good silver. The one difference is that the location of a gun show is being used to make the private sale.

Under current law, an individual is permitted to occasionally sell part, or all, of his personal firearms collection. These private sellers, however, cannot be “engaged in the business” of selling firearms. “Engaged in the business” means they can’t repeatedly sell firearms with the principal objective of earning funds to support themselves. Some of the individuals who wish to sell a portion, or all, of their personal firearms collection do so at the show and might display their wares on a table. These “private table sales,” however, are private, peer-to-peer sales and, therefore, do not require a background check. The president cannot change criminal statutes governing requirements for which sellers must conduct background checks. His new actions don’t do so and don’t claim to do so.

In a peer-to-peer, private firearms transaction, it is already illegal to sell a firearm to another individual if the seller “knows or has reasonable cause to believe” that the buyer meets any of the prohibited categories for possession of a firearm (felon, fugitive, illegal alien, etc.).

Myth No. 2: Gun shows lack any law enforcement presence and are a free-for-all for felons and other prohibited individuals to obtain firearms.

Fact:

Local, state, and federal law enforcement are often present both in uniform and/or covertly in plain clothes to monitor and intervene in suspected unlawful firearms sales such as straw purchasing; purchases made by prohibited individuals, including non-residents; and the attempted sale of any illegal firearms.

Myth No. 3: Individuals who purchase firearms on the Internet are not subject to background checks.

Facts:

An individual cannot purchase a firearm directly from a firearms retailer over the Internet and have that firearm shipped to him directly. An individual can pay for the firearm over the Internet at websites and online sporting goods retailers. The firearm, however, must be picked up from a federal firearms licensee, such as a gun store. In many cases, this is the brick-and-mortar store associated with the website where the gun purchase was made. Once at the retail store, the Internet purchaser must then fill out the requisite forms, including ATF Form 4473, which initiates the NICS background check process. Thus, an Internet purchase of a firearm from a firearms retailer requires a background check.

Individuals from the same state are able to advertise and purchase firearms from one another and use the Internet to facilitate the transaction. It is unlawful, under current law, to sell or transfer a firearm to an individual who is out of state. Any Internet sale, even between individuals, that crosses state lines would have to utilize a federal firearms licensee, such as a gun store, and the purchaser would be required to fill out the requisite state and federal paperwork and would undergo a background check.

Myth No. 4: The president’s Jan. 5 executive action on gun control represents landmark change regarding gun control.

Facts:

With few exceptions, Obama’s executive action on firearms is nothing more than rhetoric regarding the status quo. Many senators have long argued for better and more robust enforcement of existing laws that prohibit criminals from owning guns.

It is the current law of the land that anyone engaged in the business of selling firearms must have a federal firearms license. The president’s action does not change current law, but merely restates existing court rulings on the meaning of “engaged in the business.

 

Myth No. 5: The Obama administration has made firearms enforcement a priority.

Facts:

The Obama administration has used its limited criminal enforcement resources to focus on clemency for convicted and imprisoned felons, the investigation of police departments, and civil rights cases. The latter two categories represent important work, but the Department of Justice lost track of one of its core missions of enforcing criminal law: prosecuting violent criminals, including gun criminals.

The Obama administration is only now making firearms enforcement a priority. Clearly, enforcing the gun laws is a new initiative, or one of the president’s actions would not have been informing all of the 93 U.S. attorneys about it.

Proof of this lack of enforcement is revealed in the decline of weapons-related prosecutions during the Obama administration. As data obtained from the Executive Office of United States Attorneys, through a Freedom of Information Act request, reveal, firearms prosecutions are down approximately 25 percent under the Obama administration versus the last year of the Bush administration.

Myth No. 6: Mental health has nothing to do with gun control.

Facts:

People with certain levels of mental illness are not permitted to own guns. Many of the recent mass killings were committed by mentally ill individuals. One of the keys to preventing further mass shootings and violence committed with firearms is addressing the issue of mental health.

Background checks to prevent the mentally ill from obtaining guns can work only if states provide mental health records to the NICS system. Too many states have failed to do so. Many of the worst offenders are states with the most stringent gun control laws. For multiple years now, many members of Congress have repeatedly called for and introduced legislation that would provide incentives for states to submit their mental health records for inclusion in the NICS database.

Myth No. 7: Obama’s executive action on gun control will thwart criminals’ ability to obtain firearms.

Facts:

The president’s executive action regarding firearms is focused primarily on individuals who attempt to purchase firearms through the background check process.

Criminals, however, obtain firearms in myriad’s of illegal ways, including home invasion robbery; trading narcotics for firearms; burglary of homes, vehicles, and businesses; and straw purchasing.

My legislation, Senate Amendment 725, was specifically designed to combat the straw purchasing of firearms as well as firearms traffickers who transfer firearms to prohibited individuals and out-of-state residents.

Myth No. 8: There is a general consensus in America that greater gun control is needed to prevent mass shootings in the United States.

Facts:

Despite the president’s statement to the contrary, polls have shown that the majority of Americans do not believe that stricter gun control would reduce the number of mass shootings in the United States.

The American public does not believe that making it harder for law-abiding Americans to obtain guns makes America safer. In fact, polls have shown that a majority of Americans think the United States would be safer if there were more individuals licensed and trained to carry concealed weapons. A majority opposes re-imposition of the “assault weapons” ban.

Myth No. 9: The terrorist “no-fly” list is a proper mechanism to bar Americans from purchasing firearms. —Obama, Jan. 5, 2016.

Fact:

The no-fly list is actually multiple lists, which are generated in secret and controlled by executive branch bureaucrats. The Second Amendment right to bear arms has been determined by the U.S. Supreme Court to be a fundamental right. This puts the right to bear arms in our most closely guarded rights, similar to the rights to free speech and freedom of religion. It is unconstitutional to deprive an American citizen of his Second Amendment right without notice and an opportunity to be heard.

Myth No. 10: Gun retailers need to step up and refuse to sell semi-automatic weapons. —Obama, Jan. 5, 2016.

Fact:

There is nothing unlawful about a semi-automatic firearm. A semi-automatic firearm simply means that a round is discharged with each pull of the trigger. These include most shotguns used for waterfowl hunting and rifles commonly used for target shooting.

In his new book, At the Brink, economist and author John R. Lott Jr., assesses the presidency of Barack Obama and recalls conversations regarding gun laws they had while working at the University of Chicago.

In Chapter Three, Mr. Lott discusses gun-control and takes the reader back to his time at the University of Chicago, where he and then-professor Barack Obama spoke on numerous occasions about guns in America.

“I don’t believe people should be able to own guns,” Obama told Lott one day at the University of Chicago Law School.

Lott explains that he first met Obama shortly after completing his research on concealed handgun laws and crime.

“He did not come across as a moderate who wanted to bring people together,” Lott writes.

After he introduced himself to Obama, Lott suggested that they have lunch one day to discuss their views on guns.  According to Lott, Obama “grimaced and turned away.”  That was the way many conversations with Obama ended, Lott says.

Although the Law School was famous for the openness of its faculty and friendly engagement, Lott says, “Obama…preferred silent, scowling disdain to collegiality.”

President Barack Obama describes his views on guns much differently now that he is on the national stage, Lott believes, pointing to an interview on Fox News in which Obama states, “I have said consistently that I believe that the Second Amendment is an individual right.”

But, Lott isn’t convinced:

“Despite his assurance to Fox News that he understands the Second Amendment, it’s a good bet that the positions Obama took on guns during his time at Chicago reveal his true convictions.”

The chapter documents the actions that Obama has taken on guns, citing the following:

  • In 1996, Obama supported a ban on handguns
  • In 1998, he supported a ban on the sale of all semi-automatic guns
  • In 2004, he advocated banning gun sales within five miles of a school or park, which would have shut down nearly all gun stores

Mr. Lott concludes the chapter, titled, “Bewitched, Bothered, and Bewildered,” writing, “Barack Obama is the most anti-gun president ever.  That claim is based not on my own interactions with him back in the 1990’s but on his own public record over many years.”

He ends with a warning:

“The greatest threat is in his [Obama’s] power to reshape the federal courts…Each appointment to the Supreme Court could determine whether

President Barack Obama unveiled his forthcoming executive actions on gun control on Monday, and will spend the week promoting them in the press.

The formal announcement will come at a White House ceremony on Tuesday, and Obama will also host a live town hall meeting in conjunction with CNN on Thursday.

Gathered below are 15 things every American needs to know about the new executive orders.

1. The orders stop short of requiring universal background checks — According to Politico, “While Obama cannot unilaterally require universal background checks, top administration officials predicted the new guidelines would sweep in all but the most casual sellers.”

2. House Speaker Paul Ryan said Obama is subverting the constitution — “While we don’t yet know the details of the plan, the president is at minimum subverting the legislative branch, and potentially overturning its will,” he said in a statement, the Washington Examiner reported. “His proposals to restrict gun rights were debated by the United States Senate, and they were rejected. No president should be able to reverse legislative failure by executive fiat, not even incrementally. The American people deserve a president who will respect their constitutional right — all of them. This is a dangerous level of executive overreach, and the country will not stand for it.”

3. Ted Cruz responded by raffling off a shotgun — On Sunday, the senator from Texas set up a webpage offering his supporters the change to win a shotgun engraved with his presidential campaign logo, MarketWatch reported. Cruz also said he would undo Obama’s executive orders and strengthen Second Amendment rights as president.

4. Donald Trump would “unsign” the orders as president — The GOP frontrunner told a packed rally in Biloxi, Mississippi, on Sunday that he is opposed to Obama’s gun control plans. “There’s an assault on the Second Amendment. You know Obama’s going to do an executive order and really knock the hell out of it,” Trump said, according to CNN. “You know, the system’s supposed to be you get the Democrats, you get the Republicans, and you make deals. He can’t do that. He can’t do that. So he’s going to sign another executive order having to do with the Second Amendment, having to do with guns. I will veto. I will unsign that so fast.”

5. Marco Rubio vowed to undo Obama’s orders on “day one” — Speaking Sunday evening in New Hampshire, the second primary state and a thoroughly pro-gun state, Rubio said Obama “has waged war on the Constitution” by issuing executive orders against the Second Amendment, Time magazine reported. “Don’t worry,” he continued, “on my first day in office, behind that desk, don’t worry, those orders are gone.”

6. The orders will reduce background check exemptions for many hobbyists — Currently, gun sales by hobbyists and collectors do not require background checks, but sales by professional gun dealers “engaged in the business” of dealing guns do require background checks (and also require the seller to obtain a federal license). The new executive orders will seek to limit hobbyist exemptions by clarifying an existing law so that sellers who sell firearms at gun shows and online can be classified as professional gun dealers, USA Today reported. This will narrow, but not close, what some call the “gun show loophole.”

7. Hobbyist exemptions are not based on sales location or numbers — After meeting with Obama on Monday, Attorney General Loretta Lynch said, “Let me be clear: It’s not where you are located but what you are doing that determines whether you are engaged in the business of dealing in firearms.” Likewise, the order does not set a numerical threshold on what differentiates hobby sales from professional sales. Lynch did note, however, that as few as two gun sales have in the past triggered background check requirements, as determined by the courts.

 8. Exemptions will be determined holistically — White House Senior Adviser Valerie Jarrett said the ATF will take into account all the “facts and circumstances” of the gun seller when determining exemption status. Things like business cards, ability to take credit-card payments, profit margins, and original packaging are all part of the equation.

9. Obama requested more money for mental healthcare
— The president requested $500 million be added to the federal budget in order to improve access to mental healthcare.

10. The FBI’s background check system will get more staff — One of Obama’s executive orders requires the hiring of more staff, 230 examiners, so that the government is equipped for “processing background checks 24 hours a day, 7 days a week,” Fox News reported. This is a roughly 50-percent staff increase.

11. The orders will NOT ban large capacity magazines — Ahead of the announcement, the Obama administration considered several measures that it ultimately decided it didn’t have the power to do. One of those things was banning large capacity magazines for firearms, USA Today reported.

12. The orders will NOT ban people using the terrorist “no fly” list — After the San Bernardino terrorist attack, many called for banning anyone on the federal “no fly” list from obtaining firearms. Many said this was a terrible idea, as many prominent people and representatives who are clearly not involved in terrorist activity have appeared on the list in the past.

13. Obama also issued a presidential memorandum on “smart guns” — According to USA Today, “Obama directed the departments of Defense, Justice, and Homeland Security to study ‘smart gun’ technology to prevent accidental gunshots and allow better tracking of lost and stolen guns — with the idea of using the federal government’s purchasing power to encourage gun makers to market safer firearms.”

14. The orders would not have stopped recent mass shootings
— Obama’s executive orders would not have stopped the San Bernardino shooters, nor the Charleston church shooting, as perpetrators in neither case bought their guns under the hobbyist exemption. In fact, after the terrorist massacre in San Bernardino, The Associated Press reported, “The deadly shooting in San Bernardino happened in a state with some of the nation’s toughest gun laws: California bars assault weapons, blocks the sale of large-capacity magazines, and requires universal background checks for all gun purchases.”

15. The Supreme Court could stall and strike down Obama’s orders — After the president tried to unilaterally overhaul the nation’s immigration system via executive order, the Supreme Court issued an injunction, and the legality of the orders is now under review, Politico reported. Like the immigration orders, Obama’s gun control measures could also come under judicial review.

Obama is testing the water to see what he can get away with. This, along with many other things he has already done are not constitutional, not legal, and far beyond his authority as our president!

Last evening, while listening to Mark Levin interview John Lott, author of “More Guns, Less Crime”, Mr. Lott stated that back in the 1996 era he and Barack Obama spoke to each other various times when Obama was a part time speaker at Columbia University(approx. 3 hours a week). Apparently, Obama had this little job only to get himself in position to get involved in politics–he claims to be a constitutional law professor–More Bull Crap! At one or more of these visits, Obama told Lott that he didn’t believe that American citizens should be able to even own guns!! Hence, We’ve Already Known This All Along–Look Back At All Of His Previous Actions And Orders Against Our Gun Rights!

I am hoping that something is really true that I heard in an interview of Congressman John Culberson by Michael Savage yesterday! Congressman John Culberson stated that he is in charge of the committee that has control of the purse strings needed to fund all of this new stuff–that Attorney General Loretta Lunch has to get his approval and he said he will deny her request for all funding! He also stated that, in the next 10 days, he will be defunding many other things involving other issues! Here’s Hoping For A Reason To Have Hope!!

For starters, Marco Rubio And Donald Trump are on my ____ list! Ethanol is bad for our engines, Bad, Bad, Bad!!!  It’s ruining our cars, motorcycles, Boat motors, lawn mowers, and every other internal combustion engine powered anything that we Americans love that runs on gasoline!  Down with ethanol and anyone that ever speaks positively about it!!!!!!! Stop Ethanol Forever And Always!!!!!!!!!!

Besides, Corn Is Supposed To Be A Food Source For Humans And Animals–Using Corn To Make A gasoline Additive Makes Corn As A Food Source Very Expensive!!!!!!

If They Have To Kiss Ethanol Butts, And Environmentalist’s Butt’s, And Liberal’s Butt’s To Get Elected, We Don’t Need Them!!!!!!!

Immigration and Nationality Act of 1952
The Immigration and Nationality Act, or INA, was created in 1952. Before the INA, a variety of statutes governed immigration law but were not organized in one location. The McCarran-Walter bill of 1952, Public Law No. 82-414, collected and codified many existing provisions and reorganized the structure of immigration law. The Act has been amended many times over the years, but is still the basic body of immigration law.
 The INA is divided into titles, chapters, and sections. Although it stands alone as a body of law, the Act is also contained in the United States Code (U.S.C.). The code is a collection of all the laws of the United States. It is arranged in fifty subject titles by general alphabetic order. Title 8 of the U.S. Code is but one of the fifty titles and deals with “Aliens and Nationality”. When browsing the INA or other statutes you will often see reference to the U.S. Code citation. For example, Section 208 of the INA deals with asylum, and is also contained in 8 U.S.C. 1158. Although it is correct to refer to a specific section by either its INA citation or its U.S. code, the INA citation is more commonly used.
